1. Acceptance of Terms

By accessing and using VelocityKit, you accept and agree to be bound by these Terms, our Privacy Policy, and our License Agreement. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

VelocityKit is a production-ready SaaS starter kit that provides source code, documentation, and development tools to help you build and launch SaaS applications. The Service includes:

Access to download the VelocityKit codebase
Updates and improvements for the duration specified in your purchase
Documentation and development guides
Access to your account dashboard

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes where possible.

3. User Accounts

Account Creation

To access certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

Account Termination

We may terminate or suspend your account for violation of these Terms. You may also delete your account at any time through your account settings. Upon termination, you retain rights to any code you have already downloaded under the terms of the License Agreement.

4. Purchases and Payments

One-Time Purchase

VelocityKit is available as a one-time purchase. Your purchase includes:

A perpetual license to use the VelocityKit codebase (see License Agreement)
12 months of updates, bug fixes, and improvements from the date of purchase
Access to download the latest version during your update period

After Your Update Period

When your 12-month update period ends, you retain full rights to use the version of VelocityKit you have downloaded. You will no longer receive new updates unless you purchase an update extension.

Price Changes

We reserve the right to change our prices at any time. Price changes do not affect existing purchases.

Refunds

Due to the nature of digital products with instant access, all sales are final once access has been provided. Please see our Refund Policy for details.

5. License and Intellectual Property

Your use of the VelocityKit codebase is governed by our License Agreement. Key points include:

The code is licensed, not sold
You may use the code to build unlimited commercial products
You may not redistribute, resell, or share the VelocityKit source code
You may not create competing starter kit products

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Upload malicious code or attempt to gain unauthorized access
Interfere with or disrupt the Service or servers
Use the Service for any illegal or unauthorized purpose
Harass, abuse, or harm another person
Share your account credentials with others
Attempt to circumvent any security or license restrictions

7. Your Content

You retain ownership of any content you create using VelocityKit. The products you build with VelocityKit belong entirely to you. We claim no rights over your application code, data, or business.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Third-Party Services

VelocityKit integrates with third-party services (Supabase, Stripe, PostHog, Resend, Vercel, etc.). You are responsible for complying with the terms of service of any third-party services you use. We are not responsible for the content, privacy policies, or practices of any third-party services.

10. Disclaimer of Warranties

THE SERVICE AND ALL CODE PROVIDED ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. You are responsible for testing and validating the code for your specific use case.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELOCITYKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you paid us for your purchase of VelocityKit.

12. Indemnification

You agree to indemnify, defend, and hold harmless VelocityKit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VelocityKit operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us at support@velocitykit.dev. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts in the jurisdiction where VelocityKit operates.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page, updating the "Last updated" date, and if you have an account, sending you an email notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, License Agreement, and Refund Policy, constitute the entire agreement between you and VelocityKit regarding the Service and supersede all prior agreements and understandings.
